
CVUC LAWSUIT AGAINST GOVERNOR FOR VIOLATING
“Crime Victims Bill of Rights Act”
On March 29, 2010, Crime Victims United of California (CVUC) filed a lawsuit in San Diego Superior Court challenging the various constitutional violations by Governor Schwarzenegger and the CDCR with their “early release” policies.
The early release of California inmates is in direct conflict with what California voters overwhelmingly passed in 2008. As we have been warning for years, without proper reahabilitation and re-entry to our counties, there will be new victims. Crime Victims United of California finds this to be completely unacceptable and is seeking a temporary restraining order to IMMEDIATELY stop the early release and protect California citizens.

CRIME VITIMS UNITED OF CAIFORNIA PREVAILS IN FIRST ROUND OF HEARINGS ON EARLY RELEASE
On August 27, 2010 in San Diego Superior Court Judge Ronald Prager ruled that there was a factual basis to CVUC's landmark request for an injunction preventing Governor Arnold Schwarzenegger and the California Department of Corrections and Rehabilitation (CDCR) from continuing with their dangerous early release policy. Despite the stay of a three-judge panel order Governor Schwarzenegger and CDCR have implemented a dangerous early release policy - wherein violent felons are being placed back into California communities without supervision or rehabilitation jeopardizing public safety. On March 29, 2010 CVUC filed a law suit for the continual violations of victims’ rights under this policy. Judge Ronald Prager summarily denied the Governor and CDCR’s request for a demur stating that CVUC had stated facts sufficient for a court determination.
The hearing for the preliminary injunction will be heard on October 15, 2010 in San Diego Superior Court.
